Making both a Durable Health Care Power of Attorney and a Living Will can prevent a court appointed guardian making risky medical decisions on your behalf and can ensure that you don’t receive any unwanted medical treatments
A Health Care Power of Attorney and a Living Will are both legal documents that allow you to designate a person (an "Agent") who will have the authority to make health care decisions on your behalf if you are unconscious, mentally incompetent, or otherwise unable to make such decisions.
With a Health Care Power of Attorney you will have complete control over the medical treatment you receive even when you are unable to make these decisions on your own behalf! In addition, with a Living Will, and unlike a Health Care Power of Attorney, you can also express your specific wishes regarding whether you wish to receive "life-sustaining procedures" if you become permanently comatose or terminally ill.
Appoint someone to make decisions on your behalf
…. You decide who should be appointed as your lawful attorney to make medical decisions on your behalf should you become incapacitated!
Avoid having a court appointed attorney
…. You avoid having a court appointed guardian make medical decisions that could adversely affect you!
Security of knowing the person you appointed in trustworthy
…. You will have the security of knowing that the person who has been appointed as your attorney is someone that you can trust to make these important health care decisions.
Security of knowing that your best interests are being acted upon
…. You will have the security of knowing that your lawful agent will act in the best interests of you and your family!
Limit the powers granted to your agent
…. You can give your agent limit the rights given to your attorney under a Health Care Power of Attorney and under a Living Will, or you can give your agent full rights to make decisions on your behalf – the choice is yours not someone else’s!
